The debate on the use of Artificial Intelligence (AI) within the judicial system has raised numerous questions about the future of justice and law. Jack Kieffaber, author of the article "Predictability, AI, and Judicial Futurism" published in the Harvard Journal of Law & Public Policy, presents the hypothesis of a model called "Judge.AI" that could replace the role of judges and lawyers, not only applying the law but also providing ex-ante legal advice to citizens. Kieffaber explores the ethical and legal implications of artificial intelligence, studying how automated technologies can transform the legal system. This scenario paints a future in which predictability becomes the central value, and artificial intelligence offers rigorous and uniform management of the law.


The idea of a fully automated judicial system is radical, but at the same time, it reflects a reality in which technologies are becoming increasingly integral to our lives. Already today, algorithms and AI models are used to analyze large volumes of legal data, assist in drafting documents, and predict outcomes of certain legal cases. However, a system like Judge.AI represents a significant shift, where justice is entrusted to an automated entity, transforming both the technological approach and the perception of law.


But is it really possible that such a system represents a utopia? Or is it more realistic to see it as a dystopia, where every human nuance of justice is eliminated? There are many questions, and the answers often depend on the ethical and philosophical perspectives of those posing them.

The proposal for Judge.AI is rooted in the idea that predictability is the ultimate goal of the law. According to proponents of "textualism," an approach that relies on the strict literal interpretation of legal texts, an AI like Judge.AI represents the realization of this ideal, eliminating every possible interpretive ambiguity typical of human beings.


Predictability is a fundamental component of a fair and consistent legal system. When citizens know with certainty how the law will be applied, they can act in an informed and conscious manner. In this context, a fitting example is a hypothetical democratic republic created in 2030, where laws are written by human legislators but applied and interpreted by Judge.AI. The model can provide judicial decisions regarding behavior ex post, but can also offer advisory opinions ex ante, responding to citizens who ask whether a future action might be considered legal.


This predictive function is particularly interesting: it would drastically reduce legal uncertainty and could lead to the elimination of precedent-based jurisprudence and the overcoming of common law. Common law, which has evolved over centuries through past decisions and judicial interpretations, would be replaced by a form of predictive and precise justice. In this way, any legal ambiguity would be minimized, and the application of the law would become uniform, regardless of who is involved in the process.


The loss of a precedent-based system implies a significant loss of flexibility, reducing the ability of law to adapt to new realities and emerging challenges. Common law is adaptable; it evolves in response to social changes and new situations that arise. Judge.AI, as accurate as it may be, might not be able to adequately respond to new or unforeseen situations. Strict adherence to the law, without considering particular circumstances, could lead to decisions that are unjust or inadequate. This type of formal application of the law lacks the flexibility needed to handle complex situations, potentially causing injustices.


Furthermore, Jack Kieffaber's article explores in detail the potential implications of a strictly textualist approach. One of the main criticisms raised concerns the risk that a fully automated judicial system may not be able to evolve in response to new ethical or social challenges. For instance, changes in the social fabric requiring updates to laws might not be effectively managed by a system that lacks the ability to "interpret" in a human sense. This would lead to rigidity in the system, potentially succumbing to the same inefficiencies that traditional law had sought to overcome through jurisprudence as an evolutionary tool.


Ethical Implications and Challenges

The introduction of a system like Judge.AI, which offers mathematical predictability, inevitably raises moral and philosophical questions. Those who see this future as a utopia might argue that Judge.AI eliminates distortions arising from human error, biases, and discretionary interpretation. The law would be applied uniformly and consistently, thus ensuring maximum possible transparency.


Imagine, for example, a world where there are no longer differences in treatment based on gender, ethnicity, or social status. Judge.AI, being devoid of human prejudice, could contribute to greater equity in justice. Every decision would be made solely based on facts and laws, without the influence of subjective factors that too often come into play in traditional courts. This could represent a significant step forward towards a fairer and more equal society.


However, the flip side is equally important. Completely eliminating the human factor also means eliminating empathy and the ability to interpret social contexts, which are crucial for making balanced judicial decisions. Justice is not always about applying a fixed rule; it may require consideration of individual circumstances and morality, aspects that an automated system may not be able to understand or adequately evaluate.


For instance, the role of juries, which are a fundamental element for fact-checking and reflecting social sensitivities, would be called into question. Juries are composed of ordinary citizens and allow the voice of the people to directly enter decision-making processes. Judge.AI could analyze facts and apply the law with precision, but this would mean removing decision-making power from ordinary citizens and turning justice into an exclusively algorithmic process. This could generate a sense of alienation and detachment from justice, with the perception that the legal system is no longer in the hands of the people.


Another critical aspect concerns the lack of adaptability of an automated system, which lacks the capacity to evolve and respond to social challenges as dynamically as human justice. For instance, jurisprudence has often played a key role in expanding civil rights and protecting minorities. An AI, which merely interprets existing law without considering the social context in which it operates, might not be able to respond adequately to the needs of an evolving society. Additionally, there is the risk that a system like Judge.AI could perpetuate existing injustices, simply applying laws that may be inherently discriminatory or no longer suitable for contemporary reality.


Kieffaber also describes how opponents of Judge.AI find the answers provided by a purely mathematical approach inadequate. From this perspective, AI might not be able to deal with situations where the law itself is at odds with emerging moral values. For example, how should an automated system behave when an outdated law is morally unjust in the eyes of the majority of the population? In such cases, a human judge might find interpretative ways to mitigate the negative effects of an outdated law, while an AI would have rigid constraints forcing it to a faithful and literal application of the rules.


Pure or Dystopian Justice?

If justice becomes a purely algorithmic process, the ability to adapt to individual circumstances is also lost. For instance, in cases of minor offenses, a human judge might decide to be lenient, considering the personal circumstances of the accused, such as family situation or mental health status. An automated system might not be able to make these considerations, instead applying laws in a rigid and uniform manner, without considering the human implications of its decisions.


An important question that arises is whether we are willing to sacrifice the humanity of justice for its predictability. And if the answer is yes, what does this mean for the very concept of justice and the role it should play in society? Should justice merely be a means of enforcing rules, or should it also represent an ideal of fairness, understanding, and compassion?


Human justice, in fact, has always shown the ability to learn from its mistakes and adapt to changing times, ensuring the flexibility necessary to face new challenges. Historic decisions that have led to significant social changes, such as the abolition of racial segregation or the recognition of the rights of same-sex couples, are often the result of judges interpreting the laws to reflect the changes in society. A purely algorithmic system might not have this adaptability, potentially locking society into a set of rigid and immutable rules.


Moreover, Kieffaber raises a further question concerning the loss of the principle of "common law" and the abolition of the precedent-based system, emphasizing how this would be one of the greatest losses in a future dominated by judicial AI. The precedent-based law allows for a gradual and adaptive evolution of the legal system, enabling judges to shape the law according to new circumstances and the emerging needs of society.


Conclusion

The hypothesis of a fully automated judicial system like Judge.AI, while fascinating, clashes with the intrinsic limitations of current generative artificial intelligence, which becomes evident when considering complex tasks with high speculative density. Generative AI is highly efficient in repetitive and structured activities, but it lacks the ability to reflect, speculate, and generate creative solutions in domains that require deep control and understanding of the context. This aspect is not merely a technological deficiency but a structural limit, highlighted by recent university research, for example, in the field of advanced mathematics. Even in seemingly logical and "algorithmic" domains like mathematics, current AI systems demonstrate an inability to overcome challenges without the critical support of human intuition.


The entropic nature of generative AI—with its still uncertain and evolving boundaries—implies that any prediction about its future capabilities is inherently unstable. Although there have been "moments of transcendence," such as extraordinary performances in strategic games (chess or Go), this does not imply linear scalability or direct applicability in much more complex areas like law. This is because, in games, there are rigid and well-defined rules, whereas in judicial systems, the dynamic and ambiguous nature of the context makes the automatic application of the law extremely challenging. Justice requires the ability to navigate moral dilemmas, adapt to evolving contexts, and consider human aspects that go beyond the mere text of the law.


An autonomous generative AI in complex tasks is currently inconceivable without critical and specialized human supervision. This is not only because AI lacks intuitive understanding, but also because learning models struggle to distinguish between apparent correlations and deep causes. In a judicial system, the inability to distinguish between context and rule could result in devastating errors. The administration of justice therefore requires a synergistic collaboration between humans and machines, where AI supports human judgment rather than replacing it.


The future of human-machine interaction in law should not aim at AI autonomy, but at its strategic integration as an amplifier of human thought. This approach avoids both overconfidence in AI's abilities and the risk of alienating the human role. A judge supported by advanced systems could access an immense amount of data, identify hidden patterns, and predict normative implications, but always with the critical and contextual control that only humans can provide. In this scenario, AI becomes a "speculative assistant," capable of stimulating deeper reflections without any claims of autonomous decision-making.


Predictability is not the ultimate value of a justice system, but its ability to tackle and resolve complex dilemmas, adapting to the ethical and social challenges of the time. Reducing justice to a mechanical process would mean giving up the ability of the legal system to evolve and creatively respond to unprecedented situations. This is a key lesson for companies and organizations considering massive AI adoption in decision-making processes: technological innovation must be designed as an enhancement of human intellect, not as a replacement.


In summary, the true potential of generative AI lies in complementarity, not replacement. Ignoring this synergy risks creating systems that are not only ineffective but potentially harmful, incapable of addressing the complexity and uncertainty that define many contemporary challenges.
